Others, however, get excited for another reason<span class=\"s1\">\u2014<\/span><span class=\"s2\">the extra income they&#8217;ll get when they report to work on a holiday.<\/span><\/p>\n<p class=\"p1\">But when it comes to Philippine holidays and its pay rules, are you\u00a0like me when I first stepped out of college\u2014ignorant as to how to calculate them, neither did I know the difference between regular holidays and non-working holidays? Every time there&#8217;s a holiday, all I was concerned about was, &#8220;Yey! Alternatively, <b>special non-working holidays<\/b> are more flexible and fall entirely under the prerogative of the Philippine president. December 24 and 31 were declared special non-working days by President Aquino so that it&#8217;ll entail closer family ties and enable us to celebrate Christmas and New Year&#8217;s Eve more meaningfully.<\/p>\n<p class=\"p1\">But exactly how\u00a0do we get paid during these days?\u00a0Here&#8217;s a clear infographic from the Department of Labor and Employment:<\/p>\n<p><img loading=\"lazy\" class=\"alignnone size-medium wp-image-6686\" src=\"https:\/\/neo-blog.kalibrr.com\/blog\/wp-content\/uploads\/2022\/09\/holiday-pay-matrix-300x288.jpeg\" alt=\"holiday-pay-matrix\" width=\"300\" height=\"288\" srcset=\"https:\/\/neo-blog.kalibrr.com\/blog\/wp-content\/uploads\/2022\/09\/holiday-pay-matrix-300x288.jpeg 300w, https:\/\/neo-blog.kalibrr.com\/blog\/wp-content\/uploads\/2022\/09\/holiday-pay-matrix-768x737.jpeg 768w, https:\/\/neo-blog.kalibrr.com\/blog\/wp-content\/uploads\/2022\/09\/holiday-pay-matrix.jpeg 1024w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>Employees who work on holidays are paid more than the overtime rate on regular days. Like, for t<span style=\"line-height: 1.5\">hose who work on regular holidays, they are paid at least 200% of the sum of their daily rate and cost of living allowance (COLA). Moreover, employees who work on special non-working days are paid just\u00a0130% of the sum of their daily rate and\u00a0COLA.<\/span><\/p>\n<p class=\"p1\">Whether you&#8217;re working on a holiday or not, remember that proper compensation for this is a right under the Labor Code. So, make sure you receive the right salary every time you&#8217;re asked or required to work on a holiday.<\/p>\n<h2 class=\"p1\"><span class=\"ez-toc-section\" id=\"Christmas_Bonus_Vs_13th_Month_Pay\"><\/span><b>Christmas Bonus Vs. 13th Month Pay<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"p1\">Christmas season is always the number one favorite time of year for salaried employees<span class=\"s1\">. <\/span>Apart from the long vacations, one thing creeping up our consciousness is a big fat paycheck comprised of Christmas bonus and 13th month pay we&#8217;ll be receiving\u2014a reward for your year&#8217;s worth of blood, sweat, and tears.<\/p>\n<p class=\"p1\">But what comprises this year-end reward? Are we all entitled to a 13th month pay and Christmas bonus? Are they both even the same?<\/p>\n<p class=\"p1\"><span class=\"s3\">Both are different. A <b>13th month pay<\/b> is a mandatory and is required by law (<a href=\"http:\/\/jlp-law.com\/library\/?article=presidential-decree-no-851requiring-all-employers-to-pay-their-employees-a-13th-month-pay\" target=\"_blank\" rel=\"noopener\"><span class=\"s4\">Presidential Decree No. 851<\/span><\/a><\/span><span class=\"s5\">). <\/span>It says that:\u00a0<em>A<\/em><em>ll rank and file employees, regardless of their employment status, and who have worked for at least one (1) month in the company are entitled to receive a 13th month pay.<\/em><\/p>\n<p class=\"p3\">It is essentially a form of monetary assistance in preparation for the Christmas season. To compute this\u00a0is you take your\u00a0monthly basic salary, divided by 12 (months in a year), times the number of months within a year you have rendered your\u00a0service.<\/p>\n<p class=\"p3\">Here&#8217;s a clearer picture:<\/p>\n<h3 class=\"p5\" style=\"text-align: center\"><span class=\"ez-toc-section\" id=\"Php_20000_monthly_pay12_x_8_months_employed\"><\/span><span class=\"s6\">[Php 20,000 monthly pay\/12 x 8 months employed]\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p class=\"p5\" style=\"text-align: center\"><strong><span class=\"s6\">[<\/span>basic monthly pay\/12 x number of months actually worked]<\/strong><\/p>\n<p class=\"p1\">On the other hand, a <strong>Christmas bonus<\/strong>, or just a bonus for that matter, is a gift or reward <i>voluntarily<\/i> given by an employer as an expression of gratitude for all the hard work you&#8217;ve done, and not because it&#8217;s an obligation that comes from a law or contract.<\/p>\n<p class=\"p1\">To recap: A 13th month pay is mandatory under the law; while\u00a0a Christmas bonus is substantially an act of kindness and generosity\u00a0from the employer.<\/p>\n<p class=\"p1\">However, there may be\u00a0instances where bonuses become demandable. Remember that you cannot demand for a bonus since it&#8217;s only given freely, unless it has already become a long-standing tradition in the company, then yes, you may demand for it.
